These Terms & Conditions apply to the website, booking system, courses, training and related services supplied by DriveStar NZ Limited (“DriveStar”, “we”, “us” or “our”). By making or paying for a booking, attending a DriveStar service, or using a paid DriveStar learning service, you agree to these terms. If you make a booking for another person, including a learner under 18, you confirm that you are authorised to make that booking and provide the information required for it.

1. What DriveStar provides

DriveStar provides driver-licence theory education, practical driver training, readiness support and related learning services. DriveStar is not the New Zealand Transport Agency (NZTA), VTNZ, AA, or a driver-licensing testing authority. We do not issue driver licences and we do not control official eligibility decisions, test availability, test fees, assessor decisions or test results.

We will provide our services with reasonable care and skill. Training is intended to improve knowledge, driving skills and test readiness, but we cannot guarantee that a learner will pass an official theory or practical test or be granted a licence.

2. Eligibility, information and documents

You are responsible for meeting the legal and course-specific eligibility requirements that apply to the licence pathway you are booking.
You must provide complete and accurate booking information and tell us promptly if relevant circumstances change.
You must provide the original identity, licence and other documents required for your pathway when requested. DriveStar may need to verify documents before training or progression is confirmed.
If information is inaccurate, required documents are not available, or you are not eligible for the service booked, we may pause, change or cancel the booking. Any refund or rebooking outcome will take account of services already supplied, reasonable committed costs and your rights under New Zealand law.

3. Bookings, course formats and availability

A booking is confirmed when DriveStar issues a booking confirmation or otherwise confirms the booking in writing. Dates, times, instructors, venues and course places are subject to availability.

Theory training may be offered as weekday morning, weekday evening or Saturday intensive programmes, as shown during booking. Practical training may be offered as 1, 3, 5 or 10 training-day packages. Unless your booking states otherwise, each practical training day is a 1-hour session.

We may make reasonable operational changes to an instructor, venue, date or time. If a material change means you cannot reasonably attend, we will work with you on an alternative and, where an appropriate alternative cannot be provided, a refund for the undelivered part of the service.

4. Prices, GST and third-party fees

DriveStar prices are in New Zealand dollars and include GST where applicable unless stated otherwise. The DriveStar price shown and accepted when your booking is confirmed is the price for that booking, unless you later agree to change the service.

Official driver-licensing application, theory test, practical test, resit and other third-party fees are separate from DriveStar course fees unless the booking page or confirmation expressly says they are included. Third-party fees and rules can change independently of DriveStar.

5. Payment

Payment must be made using a payment method offered by DriveStar and by any due date shown at checkout, on an invoice or in your booking confirmation. A place may not be secured until any required payment has been received or confirmed. If an organisation or other person books on behalf of a learner, the booking party remains responsible for the agreed charges unless DriveStar agrees otherwise in writing.

Card and payment surcharges. If a card, payment-processing or other payment-method surcharge applies to a transaction, DriveStar will disclose it separately before you confirm payment. The disclosed surcharge forms part of the total amount you agree to pay. Nothing in this clause limits any refund or other remedy you are entitled to under New Zealand law.

6. Cancellations, changes, no-shows and refunds

Please contact DriveStar as early as possible if you need to change a booking. Our standard rescheduling expectation is at least 7 days’ notice before the affected booking or course start, and any replacement date is subject to availability.

For changes requested with less than 7 days’ notice, late arrival, a missed session or a no-show, DriveStar may charge a reasonable rebooking cost or treat the affected session as used where instructor time, venue capacity or other resources were reserved for you.
We will consider genuine emergencies and exceptional circumstances reasonably.
Refund eligibility depends on the circumstances, including notice given, services already supplied and any reasonable non-recoverable commitments. We do not exclude any refund, cancellation or other remedy that you are entitled to under New Zealand law.
If DriveStar cancels a service or cannot deliver a material part of it, we will offer a reasonable alternative where possible. If no suitable alternative can be provided, we will refund the undelivered portion, subject to any additional rights you may have under law.

Any separate DriveStar Changes, Cancellations & Refunds Policy forms part of these terms. If a policy, booking confirmation or course-specific condition conflicts with a right that cannot lawfully be excluded, the law prevails.

7. Attendance and learner responsibilities

You must attend at the agreed time, follow reasonable instructor directions and behave respectfully toward staff, other learners, venue staff and members of the public. If you arrive late, the session may need to finish at the original scheduled time.

DriveStar may stop or refuse training where continuing would be unsafe, unlawful or seriously disruptive, including where a learner appears impaired by alcohol or drugs, behaves abusively, or repeatedly refuses reasonable safety instructions. Any charge or rebooking decision will be made reasonably and subject to New Zealand law.

8. Practical training vehicle requirements

Unless DriveStar has expressly agreed to provide a vehicle, practical-course learners must provide a suitable vehicle for training. The vehicle must be legally usable on New Zealand roads, have current registration and Warrant of Fitness where required, be roadworthy, have sufficient fuel or charge, and have functioning safety equipment including brakes, tyres, lights, indicators, horn and seatbelts.

An instructor may refuse to start or may stop a session if the vehicle is unsafe, unlawful or unsuitable for the training. If the problem is the learner’s or booking party’s responsibility, the affected session may be treated as a late cancellation or missed session, subject to applicable law and any reasonable exception DriveStar agrees.

9. Official tests and licensing decisions

Official test bookings and licensing decisions are made by the relevant licensing or testing authority. DriveStar is not responsible for third-party test availability, third-party fee changes, assessor decisions, cancellations or delays that are outside our control. We will provide reasonable assistance where we have agreed to support a learner with their pathway, but the learner remains responsible for complying with official requirements and attending official appointments.

10. Course materials, website and digital content

DriveStar course materials, website content and paid digital learning content are provided for the learner’s personal learning use unless we agree otherwise. You must not copy, sell, publish, share, record or commercially reuse protected DriveStar material without permission, except where permitted by law. You must not misuse the website, attempt to interfere with its security or operation, or use it for unlawful activity.

11. Privacy

DriveStar may collect and use personal information needed to assess eligibility, manage bookings, deliver training, communicate with learners and booking parties, maintain records and meet legal or operational requirements. We handle personal information in accordance with the Privacy Act 2020 and our Privacy Policy. You may ask to access or correct personal information we hold about you, subject to the Privacy Act.

12. New Zealand consumer rights

Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded or limited, including applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

Where the Consumer Guarantees Act applies, DriveStar services come with statutory guarantees, including that services will be carried out with reasonable care and skill and, where relevant, within a reasonable time and be reasonably fit for an agreed purpose. If our service fails to meet an applicable guarantee, you may have rights to a remedy under that Act.

13. Matters outside DriveStar’s reasonable control

Events outside our reasonable control can affect training, venues, staff availability or official testing arrangements. We will take reasonable steps to minimise disruption and communicate material changes. This clause does not remove any right or remedy you have where the law makes DriveStar responsible.

14. Complaints and disputes

If you have a concern, please contact us first so we can try to resolve it promptly. You can email support@drivestar.nz or call/text +64 21 045 0068. Nothing in these terms prevents you from using any complaint, regulatory, court or Disputes Tribunal process available to you.

15. Changes to these terms

We may update these terms when our services, policies or legal requirements change. The updated version will show a new “Last updated” date. Changes will apply prospectively and will not retrospectively remove rights attached to a confirmed booking, except where a change is required by law or agreed with you.

16. Governing law and severability

These terms are governed by the laws of New Zealand. If any part of these terms is found to be invalid or unenforceable, the remaining terms continue to apply to the extent permitted by law.
